Welcome to Kept
Kept is a private photo sharing platform built for families and photographers. We provide secure, full-resolution photo storage, album organization, and sharing with the people you trust. By creating an account or using the service, you agree to these terms.
Your account
You sign in to Kept using your Google account. You're responsible for maintaining access to your Google account and for any activity that occurs under your Kept account. If you believe your account has been compromised, please contact us immediately.
Your content
You retain full ownership of every photo and piece of content you upload to Kept. We don't claim any intellectual property rights over your work. By uploading content, you grant us a limited license to store, process, and deliver it to you and the viewers you authorize — and nothing more.
You are responsible for the content you upload. You confirm that you have the right to share it and that it doesn't violate anyone else's rights.
Acceptable use
Kept is designed for sharing personal and family photography. You agree not to use the service to:
- Upload, store, or share content that is illegal, abusive, or exploitative
- Share content that violates the rights or privacy of others
- Use the platform for commercial distribution unrelated to personal photography
- Attempt to access other users' accounts or data without authorization
- Interfere with the operation or security of the service
Violations of these guidelines — or of our Privacy Policy — are treated as violations of these Terms. We reserve the right to suspend or terminate any account that violates these terms, at any time and at our sole discretion.
Subscriptions and billing
Kept offers free and paid plans. Paid subscriptions are billed monthly through Stripe. You can manage your subscription, update payment methods, or cancel at any time through your billing dashboard. Cancellation takes effect at the end of your current billing period.
We may change pricing with reasonable notice. Existing subscribers will be notified before any price change applies to their account.
Data and storage
We take care to store your photos securely and deliver them reliably. Our infrastructure uses industry-standard encryption, redundant storage, and trusted cloud providers. That said, no service can guarantee perfect availability or zero risk of data loss.
We encourage you to keep your own copies of photos that are irreplaceable. While we do our best to protect what you entrust to us, we cannot be held responsible for data loss resulting from circumstances beyond our reasonable control.
Your responsibility
You are responsible for how you use Kept and for the content you share through it. You agree to indemnify and hold Kept and its operators harmless from any claims, losses, or damages arising from your use of the service, your content, or your violation of these terms. In plain language: if your actions on the platform cause a problem, that's on you, not on us.
Legal compliance
Kept operates in compliance with applicable laws and regulations. We will cooperate with lawful requests from law enforcement authorities. We expect our users to comply with applicable laws as well, including those related to privacy, intellectual property, and the protection of minors.
Service availability
We aim to keep Kept available and reliable, but we can't promise uninterrupted service. Maintenance, updates, or circumstances outside our control may cause temporary downtime. We'll do our best to communicate planned maintenance in advance.
Limitation of liability
To the extent permitted by law, Kept and its operators are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim related to the service is limited to the amount you've paid us in the twelve months preceding the claim, or $100, whichever is greater.
Dispute resolution
We hope it never comes to this, but if a disagreement arises between you and Kept, here's how we've agreed to handle it:
Governing law
These terms and your use of Kept are governed by the laws of the State of Georgia, without regard to its conflict-of-law provisions.
Try to work it out first
Before initiating any formal proceeding, you agree to contact us at privacy@kept.photo and give us 30 days to try to resolve the issue informally. Most concerns can be sorted out with a conversation.
Binding arbitration
If we can't resolve a dispute informally, you and Kept agree to settle it through final and binding arbitration, conducted on an individual basis in accordance with the American Arbitration Association (“AAA”) Consumer Arbitration Rules. The arbitration will be conducted by a single arbitrator and may take place in Fulton County, Georgia, in the county where you reside, or remotely by video or phone — whichever you prefer.
No class actions
You and Kept each agree to bring claims against the other only in an individual capacity. Neither party may participate as a plaintiff or class member in any class action, collective action, or other representative proceeding. The arbitrator may not consolidate claims from multiple parties.
Exceptions
Either party may bring a qualifying claim in small claims court. Claims related to intellectual property rights (such as copyrights, trademarks, or trade secrets) may be brought directly in court rather than arbitration.
If arbitration doesn't apply
If the arbitration agreement is found not to apply to you or your claim, you and Kept agree that any legal proceeding will be filed exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction in those courts.
Termination
You can stop using Kept at any time. If you'd like to delete your account and data, contact us at privacy@kept.photo. We may also suspend or terminate accounts that violate these terms.
Upon termination, we will delete your data in accordance with our Privacy Policy.
Changes to these terms
We may update these terms from time to time. If we make meaningful changes, we'll notify you through the application or by email. Continued use of Kept after changes take effect means you accept the updated terms.
